DOS Launches New DS-160 Form

The Department of State (DOS) has launched the anticipated new version of the form DS-160 Nonimmigrant Visa Petition. The form’s new version clarifies, in no uncertain terms, that the applicant - and no one else - must electronically sign and submit the DS-160 form. As part of a newly formatted opening page, the DS-160 advises applicants to “be aware that under U.S. law you must electronically sign and submit your own application unless you qualify for an exception. This means that you (the applicant) must check the ‘Sign Application’ button, even if someone else helped you fill the application out.”

To emphasize the point, the DOS even adds the following language to the above warning “If someone else clicks the button instead of you, your application may not be accepted.” This same warning is repeated several times throughout the DS-160 and the associated Confirmation page.

Other changes on the new form include six new questions relating to possible grounds of inadmissibility.

To better serve our clients and to protect sensitive information, our firm will now send all correspondence containing confidential information via secure and encrypted e-mail.

If you are the recipient of an encrypted communication, you will receive a series of two e-mails. The first e-mail will contain a password. The password should be used to open the second encrypted e-mail. To ensure access to the encrypted information, we recommend copying and pasting the password directly from the first e-mail to open the second encrypted e-mail (this will be explained in the e-mails you receive). If you do not receive one or both of these emails, please check your SPAM filter to be sure that one of the messages was not diverted there. Please also be advised that the e-mails will not be delivered simultaneously - it may take up to 1 hour for the second e-mail to be received.
