Cancellation of Removal for Lawful Permanent Residents

Lawful permanent residents who have been placed into removal proceedings may qualify for cancellation of removal if they:

  1. Have been a lawful permanent resident for at least five (5) years;
  2. Have resided in the U.S. continuously for seven (7) years after being admitted in any status (e.g. tourist visa); and
  3. Have not been convicted of an aggravated felony.

If in removal proceedings due to a criminal conviction, individuals may want to consult our office as soon as possible to determine whether they have been convicted of an aggravated felony.

Please note that some misdemeanors actually qualify as an aggravated felony under immigration law.

Those with brief absences from the U.S. during the seven (7) year period in which they are required to show continuous physical presence, may still qualify for cancellation of removal.

If the application for cancellation of removal is granted, individuals will remain a lawful permanent resident of the U.S.
