Cancellation of Removal for Nonpermanent Residents
Non-lawful permanent residents, may qualify for cancellation of removal if they:
- Have been physically present in the U.S. for a continuous period of not less than ten (10) years immediately preceding the date of such application
- Have been a person of good moral character during those ten (10) years;
- Have not been convicted of certain criminal offenses; and
- Show that removal would result in exceptional and extremely unusual hardship to a U.S. citizen or lawful permanent resident spouse, parent, or child
Those who have had brief absences from the U.S. during the ten (10) year period immediately preceding the application for cancellation, may still qualify for cancellation of removal.
The only ones who can apply for cancellation of removal are those currently in removal proceedings. If the application for cancellation of removal is approved, applicants will be granted lawful permanent resident status and receive a green card.
