H-1B Cap Update

As of Friday, April 20, 2012, reports indicate that the U.S. Citizenship and Immigration Services (USCIS) has received nearly 25,000 H-1B petitions towards Fiscal Year (“FY”) 2013’s congressionally mandated cap of 65,000 available visas. Additionally, USCIS has receipted 10,900 H-1B petitions for individuals with advanced degrees. Once the cap is reached, the USCIS will reject H-1B petitions for first-time employment and will not again begin accepting H-1B petitions until April 1, 2013 for FY 2014. The earliest validity date allowed on such petitions will be October 1, 2013.

The above referenced cap applies to H-1B petitions filed for new employment. Petitions filed for extensions of stay or for an H-1B nonimmigrant to change cap subject employers are not subject to the annual cap. Further, individuals approved for certain types of employers (i.e. institutions of higher education, and nonprofit government and research employers) are exempt from the cap. Also due to Free Trade Agreements, H-1B visas are currently available for citizens of Singapore and Chile.
